Court Dismisses Motion to Strike Out Student's Name in Defamation Suit


Bauchi State High Court Number Seven, presided over by Justice Lamido Kabir Umar, has dismissed a motion seeking to strike out the name of Kamila Rufa'i Aliyu, a student of Abubakar Tafawa Balewa University (ATBU), from a defamation suit filed by Dr. Usman Mohammed Aliyu, a lecturer at the university.

Dr. Aliyu had filed the suit against Professor Kabiru, Head of Department of Chemical Engineering, and Kamila Rufa'i Aliyu, alleging defamation of character. 

Kamila's counsel, Barrister Sani Mohammed, argued that the court should strike out Kamila's name from the suit because the plaintiffs did not disclose the course of action against her.

However, counsel to the complainant, Nasiru Ilelah, objected to the removal of Kamila's name, stating that the defamation emanated from the petition she wrote. 

Justice Lamido ultimately dismissed the motion, ruling that the court had found a cause of action against the second defendant.

The case has been adjourned for hearing, with Justice Lamido noting that any party dissatisfied with the ruling has a right of appeal within 90 days.

The defamation suit is linked to a petition filed by Kamila's husband, Alhaji Ja'afaru Buba, alleging that Dr. Aliyu had sexually harassed Kamila, who is a student in the Department of Chemical Engineering.
